Terms of Service

1. Agreement

By accessing and using the VACSA platform (vacsa.org), you agree to these Terms of Service. VACSA is operated by the Visual Arts Cluster of South Africa NPC (2025/355907/08).

2. The Constituency Mapping

VACSA operates a national constituency mapping programme for South Africa's visual arts sector. By submitting your profile, you:

• Confirm the information you provide is accurate and complete
• Understand your data contributes to national sector research and policy advocacy
• Agree to be contacted by VACSA for verification, opportunities, and sector updates (per your communication preferences)
• Acknowledge that aggregated, anonymised data may be shared with DSAC and research partners

3. User Conduct

When using this platform, you agree not to:

• Submit false or misleading information
• Impersonate another person or entity
• Submit multiple registrations with the same email
• Use the platform to distribute spam, malware, or unsolicited communication
• Attempt to access administrative functions without authorisation
• Scrape, crawl, or harvest data from the platform without permission

4. Intellectual Property

Content you submit (artist statements, portfolio descriptions, narrative responses) remains your intellectual property. By submitting, you grant VACSA a non-exclusive, royalty-free licence to use this content for:

• Constituency mapping and sector analysis
• Government reporting (aggregated, anonymised)
• Artist spotlights and community features (only with your explicit consent per feature)

VACSA's own content — including the AAU brand, website design, research outputs, and strategic documents — is owned by VACSA NPC and may not be reproduced without permission.

5. Opportunities & Events

VACSA lists opportunities (grants, exhibitions, residencies) and events (workshops, webinars) from third parties and partners. VACSA does not guarantee:

• The accuracy of third-party opportunity information
• Selection or success in any application process
• The quality or safety of third-party events

VACSA provides information and connections — the relationship between you and the opportunity provider is yours.

6. Limitation of Liability

VACSA provides this platform on an “as is” basis. We do not guarantee uninterrupted access, error-free operation, or specific outcomes from your participation. VACSA is not liable for any indirect, incidental, or consequential damages arising from your use of the platform.

7. Account Termination

You may request removal of your constituency profile at any time by emailing info@vacsa.org. VACSA reserves the right to remove profiles that contain false information or violate these terms.

8. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
